Terms of Service

Welcome to ONEUS US Official Store (the "Store"), operated by ARK WITH GLOBAL INC ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Store and any purchase you make through it. By using the Store or placing an order, you agree to these Terms. If you do not agree, please do not use the Store.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to make a purchase. If you are under 18, you may use the Store only with the involvement of a parent or legal guardian. By placing an order, you confirm that you meet this requirement.

2. Products and Availability

We sell official physical albums and related merchandise of the artist ONEUS. Product images are for reference only; actual items may differ slightly in color or packaging. Many albums include randomly selected inserts such as photo cards. The specific version you receive is random and is not guaranteed.

All products are subject to availability. We may limit quantities per order or per customer, and we may discontinue any product at any time without notice. Pre-order benefits and giveaway items are available while supplies last.

3. Pre-Orders

Pre-order items are sold before their official release date. By placing a pre-order, you authorize us to charge your payment method in full at the time of purchase. Estimated release and shipping dates are provided by the label and may change; we will notify you by email if they do. Pre-orders may be cancelled for a full refund at any time before the order ships. See our Shipping Policy and Return & Refund Policy for details.

4. Pricing and Payment

All prices are in US dollars. Prices, shipping rates, and applicable sales tax are shown at checkout before you confirm your order. We reserve the right to correct pricing errors, including after an order has been placed; if we cannot honor a price due to an error, we will cancel the affected order and issue a full refund.

Payment is processed by Shopify Payments and other third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method provided.

5. Order Acceptance and Cancellation

Your order is an offer to purchase. We may accept or decline any order at our discretion, including for suspected fraud, resale activity, pricing errors, or an address outside our shipping area. If we cancel an order, we will refund any amount charged.

We may also cancel orders that appear to be placed by automated means, or where multiple orders are placed in a manner intended to circumvent quantity limits.

6. Shipping, Returns, and Refunds

Shipping, returns, exchanges, and refunds are governed by our Shipping Policy and Return & Refund Policy, which are incorporated into these Terms by reference.

7. Accounts

You may create a customer account to view your order history and manage your information. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate and current information and to update it as needed.

8. Acceptable Use

You agree not to use the Store for any unlawful purpose; to interfere with or disrupt the Store or its servers; to use bots, scrapers, or other automated tools to access the Store or place orders; to attempt to gain unauthorized access to any part of the Store; or to purchase products for the purpose of unauthorized commercial resale. We may restrict or terminate your access to the Store if you violate these Terms.

9. Intellectual Property

All content on the Store — including artist names, logos, images, artwork, audio, video, text, and design — is owned by or licensed to us, the artist, or the artist's label, and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from any Store content without prior written permission.

10. Third-Party Links and Services

The Store may contain links to third-party websites or services (for example, streaming platforms or social media). We do not control and are not responsible for the content or practices of third parties. Your use of third-party services is at your own risk and subject to their terms.

11. Disclaimer of Warranties

The Store and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Store will be uninterrupted, error-free, or secure. Nothing in these Terms limits any warranty or right that cannot be excluded under applicable law.

12. Limitation of Liability

To the fullest extent permitted by law, ARK WITH GLOBAL INC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Store or any product purchased through it. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

13. Indemnification

You agree to indemnify and hold harmless ARK WITH GLOBAL INC and its officers, employees, and partners from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Store.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Store will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts. Before filing any claim, you agree to first contact us at kakaoent@arkwithglobal.com and attempt to resolve the dispute informally for at least 30 days.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Store with a new "Last updated" date. Your continued use of the Store after changes are posted means you accept the updated Terms.

16. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and us regarding the Store.
